Terms & Conditions for Quick SMS Wear

1 Acceptance of Terms

By downloading, installing, accessing, or using Quick SMS Wear (Package name: work.ranjit.quicksmswear) or any associated companion applications and web utilities provided by Ranjit Bhonsale (“Developer”, “we”, “us”, or “our”), you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must immediately cease using the application and delete it from your devices.

2 License Grant & Intellectual Property Rights

Subject to your compliance with these Terms, Ranjit Bhonsale grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Quick SMS Wear on compatible Wear OS smartwatches and Android mobile devices that you own or control, solely for your personal, non-commercial convenience.

All rights, title, and interest in and to Quick SMS Wear, including but not limited to the codebase, application design, graphics, user interface animations, logos, and documentation, are and remain the exclusive intellectual property of Ranjit Bhonsale. You may not copy, reverse engineer, decompile, disassemble, attempt to derive the source code of, modify, or create derivative works of the application or any part thereof, except to the extent permitted by applicable open-source licenses or law.

5 Hardware, Bluetooth & Connectivity Requirements

Successful SMS transmission is contingent on various hardware, environmental, and network factors outside our control:

• Wear OS LTE Smartwatches: Direct standalone dispatch requires active cellular eSIM registration, positive carrier account balance, and adequate cellular signal reception on your smartwatch.
• Bluetooth-Connected Smartwatches: Companion relay requires an active Bluetooth/Wi-Fi link to your paired Android smartphone, active companion service execution via Google Play Services, and active cellular coverage on the phone.
• Battery & Device Availability: We cannot be held liable if a message fails to dispatch due to a depleted watch battery, airplane mode, extreme power-saving mode restrictions, network dead zones, or carrier outages.
• Delivery Acknowledgments: Delivery receipts are subject to carrier network reporting and handset recipient status. The Developer does not guarantee that every SMS will be delivered promptly or at all.

6 Acceptable Use Policy

You agree to use Quick SMS Wear strictly in compliance with all applicable local, national, and international laws and regulations. You agree that you will not:

• Use the application to send spam, unsolicited bulk messages, harassment, abusive, or unlawful content;
• Transmit fraudulent, defamatory, or threatening communications to any recipient;
• Attempt to bypass, disable, or tamper with any safety safeguards or security measures built into the software;
• Use the application in any manner that could interfere with, disrupt, or impair mobile telecommunication networks or third-party devices.

7 Third-Party Services & Google Play

The application relies on services provided by Google LLC, including Google Play Store distribution, Wear OS system APIs, and Google Play Services (Wearable Data Layer). Your use of these services is governed by the Google Terms of Service.

8 Disclaimer of Warranties (“AS IS”)

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUICK SMS WEAR IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE OPERATION OF THE APPLICATION WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR COMPATIBLE WITH EVERY WEAR OS DEVICE OR TELECOMMUNICATION CARRIER.

9 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RANJIT BHONSALE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, MESSAGING CHARGES, INTERRUPTED COMMUNICATIONS, PERSONAL INJURY, OR PROPERTY DAMAGE ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE QUICK SMS WEAR, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10 Modifications, Termination & Contact Information

We reserve the right to modify or replace these Terms and Conditions at any time. When updates are published, the revised terms will be accessible on this page (https://ranjit.work/quicksmswear/terms) with an updated Effective Date. Continued use of Quick SMS Wear following any changes constitutes your binding acceptance.

We also reserve the right to suspend, discontinue, or terminate the availability of Quick SMS Wear at any time without prior notice or liability.
